DMCA & Copyright Policy

1. Our position on intellectual property
UPBLAZED respects the intellectual property of others and expects our users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and comparable laws. This policy explains how to report content you believe infringes your rights, how the affected user can respond, and what happens to repeat infringers.
2. Trademarks and game content
Game titles, logos, characters and related marks belong to their respective owners. UPBLAZED is an independent marketplace and is not affiliated with, endorsed by, or sponsored by Activision Blizzard, Rockstar Games, or any other publisher. We reference game names only to describe the services offered.
3. Reporting alleged infringement (takedown notice)
If you are a copyright owner or an authorized agent and believe material on our site infringes your copyright, send a written notice to info@upblazed.com with the subject line “DMCA Notice”. To be valid, your notice must include:
(a) your physical or electronic signature; (b) identification of the copyrighted work you claim is infringed; (c) identification of the material you claim is infringing and its location on the site (a URL is best) so we can find it; (d) your name, address, telephone number and email; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.
Please note that under 17 U.S.C. § 512(f) you may be liable for damages, including costs and legal fees, if you knowingly misrepresent that material is infringing.
4. What we do with a valid notice
On receipt of a compliant notice we will remove or disable access to the material within a reasonable time and make a good-faith effort to notify the user who posted it, passing along a copy of the notice.
5. Counter-notification
If you believe your content was removed by mistake or misidentification, you may send a counter-notice to info@upblazed.com. It must include: (a) your signature; (b) identification of the material and its former location; (c) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address and telephone number, plus a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the complaining party. We may restore the material in 10 to 14 business days unless the original complainant files a court action seeking to restrain the activity.
6. Repeat infringers
UPBLAZED will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers. We may also remove content and take action at our discretion where we have a good-faith belief that intellectual property rights are being violated.
